What is an Environmental Impact Assessment?

An Environmental Impact Assessment (EIA) is designed to protect the environment by providing the local planning authorities with a detailed evaluation on whether or not a project that is likely to have a major impact on the surrounding environment.

Who needs an Environmental Impact Assessment?

An Environmental Impact Assessment is always required for developments covered by Schedule 1 of the 2011 EIA Regulations. These projects are usually large-scale schemes with a high likelihood of environmental impact, for example airports, oil refineries and motorways.

You may also need an Environmental Impact Assessment if your project is covered by Schedule 2 of the 2011 EIA Regulations. This sets out development that hinge on whether a project is likely to have significant environmental consequences due to factors such as size, activity and location. Schedule 2 includes projects such as business parks, wind turbines, industrial projects, sports stadiums, golf courses, and large housing developments.

Overview of the Environmental Impact Assessment process:
  • Screening - Is the project likely to have a significant effect on the environment and therefore require an assessment?
  • Scoping - Determine the extent of issues to be considered in the assessment and reported in the Environmental Statement (ES).
  • Environmental Statement - Where it is decided that an assessment is required, you must prepare & submit an Environmental Statement (ES).
  • The developer must ensure that it is prepared by competent experts. The ES must be accompanied by a statement from the developer outlining the relevant expertise or qualifications of such expert
  • Review - The statutory ‘consultation bodies’ & the public must be given an opportunity to give their views about the proposed development and the Environmental Statement.
  • Decision - local planning authority decide whether or not to grant consent for the development.
